GRAN ALACANT LAWYERS ALICANTE SPANISH LAW FIRM

Spanish Lawyers, from our Spanish Law Firm obtained a Court Order from the First Instance Court Nº 5 in Elche. The Judge ordered the neighbor of our Dutch client to stop the building works being done to the front of his house. Our client’s neighbor was opening his terrace an access door to it.


The Trial has been appointed on July 5th 2010. In the meantime, the Judge has ordered the neighbor to stop the building works.

Stop of building works cases are heard on Oral Proceedings, in accordance with the Spanish Procedures Code. The Judge would decide whether the building works would have to be stopped definitely, after his review of evidence filed. This process allows to initially show enough proof of the facts being claimed, as to decide the provisional ceasing of the building works. The proof would require further examination later on to decide whether the measures would be definite or not.
