Our Spanish Lawyers, from this Spanish Law Firm have been able to open a case against several people, who were Administrators of a company in the First Instance Court Nº 1 in Denia, on Preliminary Procedure Nº 284/2008. The Defendants had sold our client of German Citizenship, a property that was put a mortgage without him being notified. They then stopped paying the loan, so this forced our client to continue paying to avoid the foreclosure of their property.
A few months earlier, our client had sued the company for the Court to force them to sign the Title Deeds and pay a small amount of money they still were to pay. The Developers contested the claim, but in the meantime they opened the mortgage which they later stopped paying.
Our client, represented by our Spanish Law Firm, was able to obtain a Court Order where the Court honoured our claim and ordered the company to sign the Title Deeds. After the Defendant’s actions to place a mortgage on the property and later stop paying it, they sold the company to a third party, who was just a front man, in spite of the fact the company did not have any further activity.
Our Spanish Lawyers filed a criminal case for these proceedings. The Court has now acknowledged the existence of evidence and will be appointing a Court date. Our claim was for the Defendants to pay a fine of 266,652.45 Euros to cover their civil liabilities.
